BY-LAW NO. 2000-14

 

BEING A BY-LAW OF THE CORPORATION OF THE

 MUNICIPALITY OF KILLARNEY PRESCRIBING

TIMES FOR SETTING FIRES AND PRECAUTIONS

TO BE TAKEN

 

 

 

WHEREAS by the provisions of Section 210, paragraphs 35 and 40, of the Municipal Act, Chapter M. 45, R.S.O. 1990 and amendments thereto, a Municipality may enact by-laws regarding fire matters.

 

 

NOW THEREFORE the Council of the Corporation of the Municipality of Killarney enacts as follows:

 

 

1.       No fires shall be set out of doors in the Municipality between the hours of eight o’clock in the morning and eight o’clock in the evening during the months of May, June, July, August, and September in each year.

 

2.       No person shall set out fires in the open air if the pile is greater than two metres in diameter and two metres in height without first obtaining a fire permit from the Fire Department.

 

3.       No person shall burn grass unless the area to be burned is less than one (1.0) hectare in size and the flaming edge is less than thirty (30) metres in length without first obtaining a fire permit from the Fire Department.

 

4.       No person shall set any fire out of doors to burn, or shall burn out of doors, any kitchen garbage, construction materials or materials made of/or containing rubber, plastic or tar.

 

5.       Without in any way limiting the prohibition set out in Section 3 above, only dry materials shall be burned in fires set out of doors.

 

6.       No person shall set any fire out of doors except in the presence of a competent adult person and this person shall be in constant attendance of any burning operation as to prevent same from spreading to or endangering other property.

 

7.       No person shall set out a fire in an area where it may spread due to grass or other vegetation or a strong wind.

 

8.       No outside fire which causes inconvenience or irritation to others shall be permitted.

 

9.       No person shall leave the site of a fire set out of doors in the Municipality without fully extinguishing the said fire.

 

10.     Every person who starts a fire shall ensure that he/she has adequate tools and water to contain the fire.

 

 

PENALTY

 

 

11.     Every person who contravenes any provision of this by-law is guilty of an offence against this by-law and shall, upon conviction therefore be subject to a fine of not more than two thousand ($2,000) dollars exclusive of costs and every fine is recoverable under the Provincial Offences Act.

 

12.     This by-law shall come into force and take effect upon the date of the final reading thereof.

MUNICIPALITY OF KILLARNEY

 

The Municipality of Killarney is a small, picturesque northern Ontario municipality serving a population of 405.  Although the town and main base of operation are located at the northern tip of Georgian Bay on Highway 637, the municipality extends south to the Key River and comprises more than 1578 square kilometers within the districts of Manitoulin, Sudbury and Parry Sound.

 

The Municipality of Killarney invites applications from qualified individuals for the position of

                                   

PUBLIC WORKS SUPERINTENDENT

 

Reporting to the Clerk-Treasurer, the Public Works Superintendent will be involved in planning and costing, departmental budgeting, and will be responsible for planning projects, doing efficiency evaluations, work evaluations and performance assessments. In this position, the individual will plan and manage all responsibilities associated with the Public Works Department, and as a working supervisor, will assist in carrying out the day-to-day operations of the Public Works Department when necessary.

 

This position is responsible for planning, directing, managing, supervising, controlling and representing all aspects of the Public Works Department, including water and wastewater management, facilities, municipal docks, roads, structures, three landfill sites, equipment and vehicles.  In addition the position encompasses all the duties and responsibilities of By-Law Enforcement.

 

The preferred applicant will be a College graduate with five years experience directly related to a Public Works environment, including small landfill operations, waste water treatment system, and certified road superintendent.  A suitable combination of education and experience may be considered.

 

The successful individual must possess excellent communication and interpersonal skills and be able to interact successfully with elected officials, staff, suppliers and the community at large.  The individual must possess excellent organizational skills and be self-motivated with the ability to manage and direct staff in their responsibilities, as well as an in depth knowledge of the Occupational Health and Safety Act and WHMIS.

 

Salary range is $42,420 to $47,745 and is commensurate with qualifications and experience.  The Municipality offers competitive compensation and a comprehensive benefit package.

Position of Councillor – Ward 1 for the Municipality of Killarney

 

 

Written “expressions of interest” to fill the current vacant councillor position in the Municipality of Killarney are being invited. This is being done in order to properly conduct the day to day operations of the municipality in a timely, responsible manner.

 

Qualifications:

Applicants must be qualified as defined in the Municiapl Act, S.O. 2001, c. 25. Applicants should possess good communication skills, both oral and written. Ability to demonstrate interpersonal skills in open forum settings such as council meetings, budget meetings, personnel meetings, etc.

 

Process:

Eligible applicants are asked to submit a written expression of interest to the municipal office within the specified timeframes of this posting stating qualifications, experience and what you can bring to Council.

The expressions of interest will be addressed by the current council members. From the applications received a decision will be reached by a vote of Council. This position will be a valid position in the council structure from the date of appointment and will conclude November 30, 2010.

Qualifications of Candidates for Council/Local Boards/School Boards

 

For council or local board where the provisions of the Municipal Act apply, a person is qualified to hold office who is:

  • Entitled to be an elector under sec. 17 of the Municipal Elections Act.
  • Not disqualified for violations of financial requirements or violations of requirements for filing financial information.
  • Not disqualified by any Act from holding such office.
  • Not disqualified under provisions as outlined in secs 90(2) and 91(1) of the Municipal Elections Act.

 

 

Qualifications of Electors

 

A person is entitled to be an elector at an election held in a local municipality (unless prohibited by the Municipal Elections Act or any other Act) if he or she:

  • Is a Canadian citizen,
  • Is at least 18 years old, and
  • Resides in the local municipality, or is the owner or tenant of land in the local municipality, or the spouse of such a person; and
  • Is not prohibited from voting as noted below or otherwise, by law.

 

 

Ineligible Individuals

 

The following are not eligible to hold office as a member of a Council:

  1. Except in accordance with section 30 of the Municipal Elections Act, 1996,
    1. An employee of the municipality,
    2. A person who is not an employee of the municipality but who is the clerk, treasurer, Integrity Commissioner, Auditor General, Ombudsman or Registrar referred to in section 223.11 or an investigator referred to in subsection 239.2(1) of the municipality, or
    3. A person who is not an employee of the municipality but who holds any administrative position of the municipality.

 

  1. A judge of any court.

 

  1. A member of the Assembly as provided in the Legislative Assembly Act or of the Senate or House of Commons of Canada.

 

  1. Except in accordance with Part III of the Public Service Act, a crown employee as defined in that Act. 2001, c. 25, s. 258 (1); 20065, c. 32, Sch. A, s. 110.

Written “expressions of interest” stating qualifications, experience and what you can bring to Council will be received by the Clerk-Treasurer up to 4:00 p.m. on April 28th, 2010 from eligible persons who wish to be considered for appointment as Councillor for the term ending November 30, 2010.

 

Only persons who are qualified to hold office as a member of a council of a local municipality, and who are entitled to be an elector under Section 17 of the Municipal Elections Act, 1996, as amended, and who are not disqualified by the Municipal Elections Act or any other Act from holding such office are eligible for appointment to fill the Council Vacancy in Ward 1.

 

In order to be qualified as an elector, an individual must be:  a Canadian citizen; 18 years of age; not disqualified under any act or prohibited by law from voting in the election, and either a resident of the municipality or the owner or tenant of land in the municipality.
